1. Introduction & Acceptance

Welcome to 8Fund ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the 8Fund platform, including our website, applications, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. Your continued use of the Services following the posting of any changes to these Terms constitutes acceptance of those changes.

These Terms constitute a legally binding agreement between you and 8Fund. Please read them carefully before using our Services.

2. Definitions

For the purposes of these Terms:

  • "Account" means a unique account created for you to access our Services
  • "Challenge" means the evaluation process traders must complete to qualify for a Funded Account
  • "Funded Account" means a simulated trading account provided to traders who successfully complete the Challenge
  • "Simulated Trading" means trading activities conducted in a simulated environment that does not involve real capital markets
  • "Profit Split" means the percentage of simulated profits shared with successful traders
  • "Drawdown" means the maximum allowable decline from peak account value
  • "User," "you," or "your" refers to individuals accessing our Services

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be located in or a resident of any restricted jurisdiction
  • Not be subject to economic sanctions or trade restrictions

Restricted Jurisdictions

Our Services are not available to residents or citizens of the following countries: United States, North Korea, Iran, Syria, Cuba, Crimea region, and any other jurisdiction where our Services would be prohibited by law. We reserve the right to update this list at any time.

By using our Services, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and refuse service to anyone at our sole discretion.

4. Account Registration

To access certain features of our Services, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You may not transfer, sell, or assign your account to any third party. We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

5. Challenge Rules & Funded Accounts

Challenge Evaluation

Our Challenge is designed to evaluate your trading abilities in a simulated environment. Each Challenge has specific rules including but not limited to:

  • Profit targets that must be achieved within specified timeframes
  • Maximum daily and overall drawdown limits
  • Minimum trading day requirements
  • Position sizing and leverage restrictions

Funded Accounts

Upon successful completion of the Challenge, you may be granted access to a Funded Account. Funded Accounts are subject to:

  • Ongoing compliance with trading rules and risk parameters
  • Regular performance reviews
  • Profit split arrangements as specified in your agreement
  • Immediate termination for rule violations

We reserve the right to modify Challenge rules and Funded Account terms at any time. Any changes will be communicated in advance where reasonably possible.

6. Simulated Trading Disclaimer

All trading activities on the 8Fund platform occur in a simulated environment. No real money is traded, and no positions are placed in live financial markets. The simulated results you achieve do not represent actual trading performance.

Simulated trading does not involve the same risks as live trading, including but not limited to:

  • Slippage and execution delays
  • Liquidity constraints
  • Market impact of orders
  • Psychological pressure of real capital at risk

Past simulated performance is not indicative of future results, whether simulated or real. You acknowledge and agree that trading in live markets with real capital involves substantial risk of loss.

7. Payment & Refunds

Fees

Challenge fees are due at the time of purchase. All fees are quoted in USD unless otherwise specified. We accept cryptocurrency payments as indicated on our platform.

Refund Policy

Challenge fees are generally non-refundable once you have commenced trading. However:

  • You may request a refund within 24 hours of purchase if no trades have been placed
  • Technical issues preventing access may qualify for a refund at our discretion
  • Free retries or discounts may be offered under certain promotional conditions

Profit Payouts

Profit payouts for Funded Account holders are processed according to our payout schedule. Minimum payout thresholds and processing times apply. We reserve the right to withhold payouts pending verification of trading activity compliance.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Exploiting platform bugs, latency, or data feed errors
  • Using third-party software to manipulate trading results
  • Account sharing or operating multiple accounts
  • Copy trading or signal following between 8Fund accounts
  • Coordinated trading with other users to game the system
  • Providing false or misleading information
  • Attempting to reverse-engineer or hack our systems
  • Any form of market manipulation or fraudulent activity
  • Violating any applicable laws or regulations

Violation of these prohibitions may result in immediate account termination, forfeiture of any pending payouts, and potential legal action.

9. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are owned by 8Fund or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to:

  • Access and use the Services for personal, non-commercial purposes
  • Download or print content for personal reference only

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any portion of our Services without our express written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 8FUND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Services
  • Any errors, bugs, or inaccuracies in the platform or simulated trading environment
  • Unauthorized access to your account or personal information

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

  • Violation of these Terms or any applicable rules
  • Fraudulent or illegal activity
  • Failure to meet Challenge requirements
  • Extended periods of account inactivity
  • Request from law enforcement or government agencies

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against 8Fund. All claims must be brought in your individual capacity.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 8Fund is incorporated, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our platform or via email. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
